L.A. Times, September 21, 2014: FCC suspends study that sought information on newsroom operations

On Friday, the FCC said Wheeler agreed that "survey questions in the study directed toward media outlet managers, news directors and reporters overstepped the bounds of what is required." An agency spokesman added that "any suggestion that the FCC intends to regulate the speech of news media or plans to put monitors in America's newsrooms is false."

Commissioner Pai said the decision to suspend the survey is "an important victory for the 1st Amendment."
The FCC plans to continue with the pilot test without the questions regarding journalistic practices.

The above, of course, refers to February 10, 2014 report by the Wall Street Journal that the FCC decided to study newsrooms to see how stories to be 'reported' are selected, how stories are reported upon, perceived 'Station Bias', and how the reporting organization assures that the community gets 'Critical Information' content delivered by the reporting organization. If this smells a little like FCC over-reach, well, you ain't smelled nothing yet.

The good news? Within two weeks of being brought out into the open by the folks at the Wall Street Journal, then picked up by both Right / Left-leaning blog sites, The Blaze, Hannity and Limbaugh Radio Shows...

The FCC reconsidered, and told the world, that the:

Meet Julie Boonstra, of Dexter, Michigan.

She was diagnosed with chronic myelogenous leukemia five years ago. In October 2013, along with an estimated 225,000 of her fellow Michiganders, she received a letter from her insurance provider informing her that her plan would be discontinued in 2014 and that she would have to purchase alternative coverage.

After weeks of unsuccessfully attempting to sign up for insurance at the HealthCare.gov site, she was finally able to enroll in a plan.

The new insurance, she hoped, would provide her with the care and medication which would keep her alive...
.
Summing up where we are thus far:

Months later, she filmed the following one-minute video clip in opposition to her local Congressman, Gary Peters's, (D-MI) participation in her personal health care debacle.

Shortly after the spot ran on local Television, the station received a letter entitled, "Unsupported Advertisement by Americans for Prosperity", from the firm Perkins & Coie in Washington, DC demanding that they stop running the ad. The letter's issuance was requested, not surprisingly, by "Peters for Michigan", Gary Peters' re-election committee.

The letter, reads in part:

"For the sake of both FCC licensing requirements and the public interest, your station should immediately require AFP (Americans for Prosperity) to provide the factual documentation for its claims if you are going to continue airing this advertisement.

Unlike federal candidates, independent political organizations like AFP do not have a "right to command the use of broadcast facilities." See CBS v. DNC, 412 U.S. 94, 113 (1973). Because you do not need to air this advertisement, your station bears responsibility for its content when you do grant access. See Felix v. Westinghouse Radio Stations, 186 F.2d 1, 6 (3d Cir. 1950), cert. denied, 314 U.S. 909 (1950).

Failure to prevent the airing of "false and misleading advertising" may be "probative of an underlying abdication of licensee responsibility" that can be cause for the loss of a station's license. See Cosmopolitan Broad. Corp. v. FCC, 581 F.2d 917, 927 (D.C. Cir. 1978).

Yeah, if I'm running for public office, I'm pretty sure the first fight I would pick in my campaign would be with a Female Cancer Patient who decided to take her personal ObamaCare story public. Sure, what could go wrong there???

The irony of the first and second sections of this post, is of course, is that the same week the FCC decides NOT to intrude into the news business, a career-politician from Michigan has his attorneys draft a cease and desist letter to minimize opposition against him, by... Using the FCC as their primary weapon of choice.

The folks who forced this legislation down our throats via non-standard legislative procedures (reconciliation), are now relying upon other Federal Agencies (they fund) to shut down any and all opposition to them.
.
IF, as I've heard said, "You never stand so tall when you stoop to help a child..."

THEN, could you fairly amend that quote to read that, "You never stoop so low as when you use your attorney's and the FCC to attack the credibility of a woman fighting cancer"?

I'm thinking that between now and the months leading up to November will be an excellent period of time in which to share your feelings about this, and any other concerns you may have regarding the current make-up of Congress.
Use your voice and share Julie Boonstra's story and other associated legislative over-reach before the FCC, Administration, or other Progressive groups decide that your voice is unnecessary to the conversation.

- She was given an option for a new plan which lowers her monthly payment, but increases her out of pocket expenses of her cancer-treatment prescriptions,
- Some of her necessary prescription medications have NO coverage under her new insurance, forcing her to pay 100% of their cost out of her own dwindling funds,
- She is not happy that her prior insurance was taken away,
- She has her new plan ONLY because men and women like her local Congressional representative, and other Democrats knew what she needed far better than she did, and,
- As a result, she could NOT keep her plan,
- She, like the rest of us, was lied to by the President, the 'then Speaker' Pelosi, current leader of the Senate Reid, and 'most' Democrats in Congress
